A paid caregiver must be at least 18, legally able to work in the U.S., and meet the same requirements as any personal care aide. A spouse (or a parent of a minor child) may be paid under Virginia's legally-responsible-individual rules: the care must be extraordinary — above and beyond what a family member would ordinarily provide — limited to help with activities of daily living, and generally up to 40 hours per week; the need is documented during assessment. Eligibility for any caregiver is determined by the program during enrollment.

Program Guide
CCC Plus — Commonwealth Coordinated Care Plus — is Virginia's Medicaid waiver for long-term services and supports at home, operated by the Department of Medical Assistance Services (DMAS) under the Cardinal Care umbrella that now covers all of Virginia Medicaid. It pays for personal care, respite, and related in-home services for people who would otherwise qualify for nursing-facility care.
Two things set Virginia apart: the waiver serves all ages with no waiting list, and the state permanently allows legally responsible individuals — a spouse, or a parent of a minor child — to be the paid caregiver in defined circumstances.
The person receiving care must have (or qualify for) Virginia Medicaid and need a nursing-facility level of care. Functional eligibility is confirmed through a screening by a community-based team — a registered nurse, a social worker, and a physician — using the Uniform Assessment Instrument (UAI). Medicare alone does not qualify.
Financial eligibility is determined by the Medicaid program — not by us, and not by any home care agency. Virginia applications run through CommonHelp online, the Cover Virginia call center, or the local Department of Social Services.
Most states bar spouses from being paid caregivers. Virginia's rules — finalized July 1, 2025 after CMS approved the waiver amendments — permanently allow a spouse (or a parent of a minor child) to be the paid attendant, in both agency-directed and consumer-directed care. The conditions matter: the care must be extraordinary, meaning above and beyond what a spouse would ordinarily provide; it is limited to hands-on help with activities of daily living; it is generally capped at 40 hours per week (the person may be authorized for more hours, with other caregivers covering the rest); respite is not available alongside a paid spouse; and the need is documented during assessment with ongoing monitoring.
In consumer-directed care, the spouse who provides the care cannot also be the employer of record — another person takes that role. These are real conditions, not fine print; whether your family qualifies is determined by the program during enrollment, and we help you check before you apply.
Virginia offers two parallel paths. Under agency-directed care, a licensed, Medicaid-approved personal care agency employs the attendant — including a qualifying family member — and handles training, scheduling, and supervision. Under consumer-directed care, the family is the employer: a services facilitator helps you learn the employer role, and a fiscal agent handles payroll and taxes.
