A paid attendant must be at least 18 and legally able to work in the U.S. By Texas program rule, a spouse (and, for a minor child, a parent) cannot be the paid attendant. Depending on the program, your chosen family member or friend is employed either by a Medicaid-approved licensed agency or through the Consumer Directed Services (CDS) option, where a financial management agency handles payroll. Eligibility for any caregiver is determined by the program during enrollment.
